These Terms & Conditions (the âTermsâ) govern your access to and use of AcrossThePondFoods.com (âAcross the Pond Foodsâ, âweâ, âusâ, âourâ) and purchases made from us. By using our website or placing an order, you agree to these Terms.

Transparency & non-misrepresentation
We strive to present accurate, complete, and truthful information. We do not make false claims, hide fees, or imply endorsements or affiliations that do not exist. If we ever make a clear error (e.g., price or availability), we will correct it and offer you the option to cancel for a full refund before dispatch.
1) Eligibility & accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase.
- Youâre responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorised use.
2) Product information, allergens & best-before dates
- We aim to describe products accurately. Minor variations in packaging, ingredients, nutrition panels, country of origin or appearance may occur due to manufacturer updates. Images are illustrative only.
- Allergen advice: Always read labels on delivery before consumption; manufacturers may change recipes/allergen statements without notice. If you have allergy or dietary concerns, contact us before ordering.
- Best-before/expiry: Dates reflect the manufacturerâs guidance. We consider transit time when picking and packing but canât guarantee remaining shelf life for international shipments once an order leaves our facility.
3) Pricing, currency, taxes & duties (full cost disclosure)
- Product prices are shown in USD ($) unless otherwise stated.
- The total amount due (products + shipping + applicable taxes/fees that we can calculate) is shown before you confirm payment at checkout.
- Import duties & taxes (outside the EU): For deliveries outside the EU (e.g., the United States), you are the importer of record and are responsible for any duties, taxes, brokerage, and compliance with local import laws. These may be collected by the carrier upon delivery if not calculated at checkout.
- We may change prices or correct obvious errors at any time. If an error affects your order, we will notify you and you may cancel for a full refund before dispatch.
4) Availability, ordering & contract formation
- Placing items in your cart does not reserve inventory.
- Your order is an offer to buy. We accept your order when we send a dispatch confirmation email. A contract forms for the items listed in that email.
- If we cannot accept an order (e.g., out of stock, address or payment issues, legal or regulatory restrictions), weâll cancel the affected items and refund any payment received for those items.
- Pre-orders / backorders: If offered, they will be clearly labelled with the expected dispatch window. You may cancel any time before dispatch for a full refund.
5) Payments & security
- Accepted methods: Visa, Mastercard, American Express, Apple Pay, Google Pay (via Stripe), and PayPal.
- Card payments are processed securely by our payment providers; we do not store full card numbers.
- We may conduct fraud/verification checks and may decline or cancel orders where fraud is suspected.
6) Shipping, risk & delivery
- We ship from Ireland to the United States and other destinations shown at checkout. Estimated delivery dates are guidance only and are not guaranteed.
- Full cost shown before purchase: Shipping costs and options are displayed at checkout prior to payment.
- Risk of loss passes on delivery to the address you provide, orâif you nominate your own carrierâupon hand-off to that carrier.
- You must provide a complete and accurate delivery address. Undeliverable, refused, or unclaimed parcels are handled per our Refund & Returns Policy.
- Customs inspections or local import rules may delay delivery. We are not responsible for delays or seizures by authorities.
7) Returns, refunds & cancellations (clear & accessible)
- Your statutory rights are not affected. Please read our Refund & Returns Policy (incorporated by reference). In summary:
- You may cancel before dispatch for a full refund.
- Due to food safety, perishable food items are generally non-returnable unless faulty, damaged, or mis-described.
- Eligible non-perishable, unopened items may be returned within 14 days of delivery with prior authorisation.
- Refunds are processed to the original payment method within a reasonable time after we receive and inspect the returned goods (where applicable).
- If an item arrives damaged or incorrect, contact us within 48 hours of delivery with photos so we can help promptly.
8) Customs, compliance & import restrictions
- You are the importer of record for deliveries outside the EU and must ensure products are lawful to import into your jurisdiction.
- Any guidance we provide on duties/taxes is for convenience only and not legal or tax advice.
9) Promotions, vouchers & gift cards
- Promotions are subject to stated terms, dates, and availability (âwhile stocks lastâ) and may be withdrawn or changed without notice where permitted by law.
- Discount codes must be entered at checkout and cannot be applied retroactively.
- Gift cards or store credit (if offered) are non-refundable and redeemable only on our website, subject to the stated validity period and applicable law.
10) Brand references & fair use (no misleading affiliation)
- We sell third-party branded goods. Unless explicitly stated on the product page, we are not endorsed by, affiliated with, or an authorised reseller for any brand we reference.
- Brand names and trademarks are used only to identify products for sale.
- If we are an authorised partner for a specific brand, we will display that status clearly and, where possible, link to the brandâs website confirmation.
11) Acceptable use
You agree not to: (a) misuse the site; (b) interfere with security or integrity; (c) scrape or harvest data without permission; (d) use automated means to access the site except for search indexing with our consent; (e) upload malware or harmful code; or (f) infringe third-party rights.
12) Intellectual property
All website content (text, graphics, logos, product images, and software) is owned by us or our licensors and protected by intellectual property laws. You may not use our trademarks without prior written consent. You may print or download portions of the site for personal, non-commercial use only.
13) User content (reviews, photos, comments)
By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, translate, distribute, and display it for marketing and operational purposes. You warrant that your content is truthful, lawful, and does not infringe othersâ rights. We may moderate or remove content that is unlawful, misleading, or abusive.

Our site integrates with third-party services (e.g., payment processors) and may link to external sites. We are not responsible for their content or privacy practices. Your use of third-party services is governed by their terms.
15) Privacy & cookies

16) Warranties & liability
- To the fullest extent permitted by law, the website and products are provided âas isâ. We exclude implied warranties of merchantability and fitness for a particular purpose, except where such exclusions are prohibited by law.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
- Subject to the foregoing, we are not liable for: (a) indirect or consequential losses; (b) loss of profits, revenue, data, or goodwill; or (c) delays or failures caused by events outside our reasonable control.
- For consumer purchases, our total liability for any claim relating to a purchase is limited to the price paid for the product(s) giving rise to the claim.
17) Force majeure
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including but not limited to acts of God, pandemics, war, strikes, transport/network failures, embargoes, or governmental actions.
18) Suspension & termination
We may suspend or terminate access if you breach these Terms or where required by law. You may close your account at any time. Termination does not affect accrued rights or obligations.
19) Changes to the Terms
We may update these Terms from time to time. Updated Terms apply from the Effective Date shown above. Material changes will be notified on the website and/or by email where appropriate.
20) Governing law & dispute resolution
- These Terms and any non-contractual obligations are governed by the laws of Ireland.
- If you are an EU consumer, you may have mandatory local consumer protections that apply in addition to Irish law.
- Disputes may be submitted to the courts of Ireland. If you are an EU consumer, you may also bring proceedings in your country of residence.
- EU consumers shopping online may use the European Commission Online Dispute Resolution (ODR) platform; our participation is voluntary unless required by law.
