These Terms & Conditions (the “Terms”) govern your access to and use of AcrossThePondFoods.com (“Across the Pond Foods”, “we”, “us”) and your purchases from us. By using our website or placing an order, you agree to be bound by these Terms.

1) Eligibility & accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase.
- You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of unauthorised use.
2) Products, allergens & information
- We strive to describe products accurately, but minor variations in packaging, ingredients, or appearance may occur due to manufacturer updates.
- Allergen advice: Always read labels on delivery before consumption. Manufacturers may change recipes. If you have dietary or allergy concerns, contact us before ordering.
- Bestâbefore/expiry dates reflect the manufacturerâs guidance; transit times are considered when we pick & pack but cannot be guaranteed once shipped internationally.
3) Pricing, currency, taxes & duties
- Prices are shown in USD ($).
- For deliveries outside the EU (e.g., United States), you are responsible for any import duties, taxes, brokerage and compliance with local import laws.
- We may change prices or correct errors at any time. If a pricing error affects your order, we will contact you; you may cancel for a full refund before dispatch.
4) Ordering & contract formation
- Placing items in your cart does not reserve them. An order is an offer to buy.
- We accept your order when we send a dispatch confirmation email. A contract is formed at that time for the items listed.
- If we cannot accept your order (e.g., out of stock, address issues, regulatory restrictions), we will refund any payment received for the affected items.
5) Payments & security
- We accept Visa, Mastercard, American Express, Apple Pay, Google Pay (via Stripe), and PayPal.
- Card payments are processed securely by our payment providers; we do not store full card numbers.
- We may run fraud/verification checks and may decline or cancel orders at our discretion if fraud is suspected.
6) Shipping, risk & delivery
- We ship from Ireland to the United States and other destinations shown at checkout. Estimated delivery dates are guidance only and not guaranteed.
- Risk of loss passes to you upon delivery to the address you provide or, for carrierâcollection services, at handâoff to the carrier if you have nominated your own carrier.
- You are responsible for providing a complete and accurate delivery address. Undeliverable or refused parcels are handled per our Refund & Returns Policy.
7) Returns, refunds & cancellations
Your statutory rights are not affected. Please review our Refund & Returns Policy (incorporated by reference). In summary:
- You may cancel before dispatch for a full refund.
- Perishable/food items are generally nonâreturnable except where faulty, damaged or misâdescribed.
- Eligible nonâperishable, unopened items may be returned within 14 days with prior authorisation.
8) Compliance, customs & import restrictions
- You are the importer of record for deliveries outside the EU and must ensure that the products are lawful to import into your jurisdiction.
- Customs inspections may delay or prevent delivery. We are not responsible for delays or seizures by authorities.
- Any guidance we provide on duties/taxes is for convenience only and not legal or tax advice.
9) Promotions, vouchers & gift cards
- Promotional offers are subject to stated terms and may be withdrawn or changed without notice.
- Discount codes must be entered at checkout and cannot be applied retroactively.
- Gift cards or store credit (if offered) are nonârefundable and redeemable only on our website, subject to the stated validity period and applicable law.
10) Acceptable use & prohibited conduct
You agree not to: (a) misuse the site, (b) interfere with security or integrity, (c) scrape or harvest data without permission, (d) use automated means to access the site except for indexing with our consent, (e) upload malware or harmful code, or (f) infringe thirdâparty rights.
11) Intellectual property
All content on the website including text, graphics, logos, product images, and software is owned by us or our licensors and is protected by copyright and other IP laws. You may not use our trademarks without prior written consent. You may print or download portions of the site for your personal, nonâcommercial use only.
12) User content (reviews, comments)
By submitting reviews, photos, or comments, you grant us a nonâexclusive, worldwide, royaltyâfree licence to use, reproduce, modify, publish, translate, distribute, and display such content in any media for marketing and operational purposes. You warrant that your content is truthful, lawful, and does not infringe othersâ rights.
13) Thirdâparty services & links
Our site integrates with thirdâparty services (e.g., payment processors) and may contain links to external websites. We are not responsible for their content, performance, or privacy practices. Your use of thirdâparty services is governed by their terms.
14) Privacy & cookies
Your use of our site is also governed by our Privacy Policy and Cookie Policy, which explain how we collect and use personal data and how you can manage cookies.
15) Warranties & liability
- To the fullest extent permitted by law, the website and products are provided âas isâ. We exclude implied warranties of merchantability and fitness for a particular purpose, except where such exclusions are prohibited by law.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
- Subject to the foregoing, we are not liable for (a) indirect or consequential losses; (b) loss of profits, revenue, data, or goodwill; or (c) delays or failures caused by events outside our reasonable control.
- For consumer purchases, our total liability for any claim relating to a purchase is limited to the price paid for the product(s) giving rise to the claim.
16) Force majeure
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including but not limited to acts of God, pandemics, war, strikes, transport/network failures, embargoes, or governmental actions.
17) Suspension & termination
We may suspend or terminate your access if you breach these Terms or if required by law. You may close your account at any time. Termination does not affect accrued rights or obligations.
18) Changes to the Terms
We may update these Terms from time to time. The updated Terms will apply from the Effective date shown above. Material changes will be notified via the website and/or email where appropriate.
19) Governing law & dispute resolution
- These Terms and any nonâcontractual obligations are governed by the laws of Ireland.
- If you are an EU consumer, you may have mandatory local consumer protections that apply in addition to Irish law.
- Disputes may be submitted to the courts of Ireland. If you are an EU consumer, you may also bring proceedings in your country of residence.
- If you are an EU consumer shopping online, you may use the European Commission Online Dispute Resolution (ODR) platform to seek to resolve a dispute; participation is voluntary for us unless required by law.
